SnapSplit — Terms of Use (EULA)

These Terms of Use (“Terms”) form a binding agreement between you (“you”, “User”) and AsOf LLC, a New York limited liability company (“SnapSplit”, “we”, “us”, “our”), governing your use of the SnapSplit mobile application and related services (collectively, the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

Subject to these Terms, SnapSplit grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at once.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. You are responsible for any activity that occurs under your account and for keeping your login credentials secure. SnapSplit supports Sign in with Apple; you may also be required to verify your email address.

3. Subscriptions, Billing & Auto-Renewal

SnapSplit offers a free tier and three auto-renewing monthly subscriptions (“Subscriptions”) sold through the Apple App Store:

The following terms apply to all Subscriptions, in line with Apple’s auto-renewing subscription requirements:

• Payment. Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. Your Subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Renewal charge. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of the selected plan.
• Managing your Subscription. You can manage your Subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase, or via Settings → [your name] → Subscriptions on your device.
• Free trial / promotional offers. If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a Subscription, where applicable.
• Refunds.All purchases are final and non-refundable except where required by law or as expressly allowed by Apple’s refund policy. SnapSplit cannot directly issue refunds for purchases made through the App Store.
• Price changes. We may change Subscription prices from time to time. Material price changes will be communicated in advance and will not apply to a current billing cycle.

Your monthly split allowance resets at the start of each billing cycle. Unused splits do not roll over.

4. User Content

The App allows you to capture photos of receipts and to associate contacts and payment handles (e.g., Venmo, Cash App usernames) with splits (“User Content”). You retain all ownership rights in your User Content. You grant SnapSplit a limited, worldwide, royalty-free license to host, store, process, transmit, and display your User Content solely to operate and improve the App for you.

You represent that you have all necessary rights to your User Content and that it does not violate any law or third-party right (including privacy rights of people whose contact information you import).

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App, our servers, or related systems.
• Use the App to transmit malicious code, spam, or harassing content.
• Resell, sublicense, or otherwise commercially exploit the App or any portion of it without our prior written consent.

We may suspend or terminate your access if we believe, in good faith, that you have violated these Terms.

6. Third-Party Services

SnapSplit integrates with or references third-party services, including Apple’s App Store, Sign in with Apple, RevenueCat (for subscription management), Venmo, and Cash App. SnapSplit is not affiliated with Venmo or Cash App. Your use of any third-party service is governed by that service’s own terms and privacy policy. SnapSplit is not responsible for the content, accuracy, or practices of third parties.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share information.

8. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that receipt scans will be accurate. SnapSplit does not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

SnapSplit is a math and organizational tool. You are responsible for verifying any totals, line items, and payment requests before sending or settling them. SnapSplit is not a payment processor and does not move money on your behalf.

9. Limitation of Liability

To the maximum extent permitted by law, SnapSplit and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the App. Our total aggregate liability for any claim arising out of or related to these Terms or the App shall not exceed the greater of (a) the amount you paid SnapSplit in the twelve (12) months preceding the claim or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless SnapSplit from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of (a) your User Content, (b) your use of the App, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

11. Apple-Specific Terms

You acknowledge that these Terms are between you and SnapSplit, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App; to the maximum extent permitted by law, Apple will have no other warranty obligation. You and SnapSplit acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

You represent that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or by email. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.

13. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. You and SnapSplit agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York for any dispute arising out of or relating to these Terms, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.
